The High Court on Monday dismissed a case seeking removal of the electoral commission’s top officials over the nullified August 8th presidential poll. In his ruling Justice John Mativo said that the petition against the Independent Electoral and Boundaries Commission (IEBC) chief executive officer, Ezra Chiloba and the commissioners is unmerited and has no legal basis. The three petitioners, Brian Asin, Ben Wanasakaami, and Kevin Alwang’a were seeking the order on grounds that the integrity of Chebukati and his team is in question following nullification by the Supreme Court of President Uhuru Kenyatta’s re-election. The three petitioners also wanted the IEBC commissioners barred from conducting the fresh presidential election, claiming that since they oversaw August 8th presidential election which was nullified them thus cannot be trusted. The Supreme Court last month nullified President Kenyatta’s re-election on grounds that the August 8th poll was not conducted in accordance with the Constitution and applicable principles.
